Tennessee to Change Child Custody Laws; Court Abuses

New Push in Tennessee to Change Child Custody Laws: The Avin & Preston Law, Named After Danielle Malmquist’s Children

Danielle Malmquist, the Tennessee mother of two young boys, who has only seen them approximately three hours in the last year after a horrifying custody battle waged by her ex-husband, Shem Malmquist, has been getting support from the legislature in Tennessee thankfully.  Tennessee HB 677 sponsored by B. Cooper (and SB 2213 sponsored by O. Ford) is named after Danielle’s two boys, the Avin & Preston Law.  It is currently in subcommittee in the House and the Senate…check the links above for more recent developments as they occur.  The law specifically pushes for the following:

  • For a judge to document the reason why the parent is placed on supervised visitation
  • For both parents to share the cost of the supervised visits
  • Set a cap on those visits at $40 an hour
  • Set up a reconciliation plan to work towards ending the supervised visits

See the news report on the bill here at WSMV.  Supporters hope to have the bill take affect this summer.  If you are in Tennessee, please drop a line to your representatives and ask them to support this legislation for the children who live in custody hell.

As Danielle put it in the news report, the judges think they are trying to punish these mothers that are (unjustly) put on supervised visitation, but what they are doing is hurting the children in the case.  Amen to that Danielle.
