Judge dismisses charges in Topeka police shooting

TOPEKA | A judge has dismissed all charges against a Topeka police officer in the shooting of two brothers outside a 2008 St. Patrick's Day gathering.
Officer Jason Judd had been charged with two counts of aggravated battery and misdemeanor criminal trespassing in the shooting of 28-year-old Daniel Llamas and 19-year-old Devin Llamas.
The brothers were shot after a fight with Judd and three other off-duty officers.
Shawnee County District Court Chief Judge Nancy Parrish wrote in her dismissal order Friday that the officers showed "inexcusably bad judgment," but that wasn't the issue. Parrish wrote the state could still dismiss the charges.
Special prosecutor Cindi Carle had sought to dismiss the case, saying there wasn't enough evidence to prosecute.
